1. Introduction
- These Terms and Conditions ("Agreement") are entered into by and between you ("Customer", "you", or "your") and Anglia Computer Solutions Business Limited, trading as ACSHOST ("ACSHOST", "we", "us", or "our"). By using our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement, our Privacy Policy, and our Usage Policy.
2. Services Provided
- ACSHOST provides web hosting, domain registration, email, VPS, and related services as described on our website. We reserve the right to modify, suspend, or discontinue any service at any time.
3. Account Registration and Security
- You must provide accurate and complete information when registering for our services.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
- You agree not to use our services for any unlawful, harmful, or abusive purpose, including but not limited to hosting, transmitting, or distributing illegal, adult/mature, or otherwise prohibited content.
- Prohibited activities include, but are not limited to: spamming, phishing, hacking, distributing malware, or violating the intellectual property rights of others.
- We reserve the right to scan, monitor, and remove any content that violates this Agreement or our Usage Policy.
5. Content and Data
- You are solely responsible for all content and data stored or transmitted through our services.
- You must ensure that your content complies with all applicable laws and regulations.
- We may remove or disable access to any content that violates this Agreement or applicable law.
6. Domain Registration
- Domain registrations are subject to the terms and conditions of the relevant registry and ICANN policies.
- You are responsible for ensuring the accuracy of domain registration information and for renewing your domains before expiration.
- Failure to renew a domain may result in permanent loss of the domain name, and ACSHOST accepts no responsibility for domains not renewed on time.
7. Email Services
- Use of our email services for sending unsolicited bulk email (spam) is strictly prohibited.
- Bulk email campaigns may only be sent with prior written approval from ACSHOST.
- We may suspend or terminate accounts found to be sending spam or otherwise abusing email services.
8. Service Level Agreement (SLA) Disclaimer
- While we strive to provide reliable and continuous service, ACSHOST does not guarantee any specific uptime, response time, or service level. No credits or compensation will be provided for downtime or service interruptions.
9. Backups & Data Responsibility
- ACSHOST performs nightly backups of hosting accounts for disaster recovery purposes only. Customers may request restoration in the event of data loss, but ACSHOST does not guarantee the availability, completeness, or accuracy of backups.
- Customers are solely responsible for maintaining their own backups of all data and content stored or transmitted through our services.
10. Resource Usage / Fair Use Policy
- All hosting packages are subject to resource limits, including but not limited to bandwidth, disk space, CPU, and memory, as specified in your plan.
- Excessive or abusive use of resources may result in suspension, throttling, or termination of your service at our discretion.
11. Refunds / Cancellations
- All services are non-refundable unless otherwise stated in writing. You may cancel your services at any time, but no refunds will be issued for unused portions of service. This does not affect any statutory rights you may have under UK consumer law.
12. Suspension and Termination
- Suspension of services will continue to incur charges until the reason for suspension is resolved or the account is terminated. Suspended accounts must still pay all outstanding invoices.
- Termination is effective immediately in the event of a serious breach of these Terms and Conditions or our Usage Policy. Data may be deleted upon termination.
- Illegal activities may be reported to the relevant authorities.
13. Third-Party Services / Dependencies
- Some services rely on third-party providers, such as domain registrars, upstream network providers, and data centres. ACSHOST is not liable for outages, failures, or service interruptions outside our direct control.
14. Dispute Resolution
- All disputes must be submitted to ACSHOST in writing. We will attempt to resolve disputes amicably before any legal action is taken.
- If a resolution cannot be reached, disputes will be subject to the jurisdiction specified below.
15. Age / Eligibility
- You must be at least 18 years old or have the legal capacity to enter into a binding contract to use our services.
16. Force Majeure
- ACSHOST shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, power grid failures, or acts of government.
17. Payment and Billing
- All fees are due in advance unless otherwise agreed in writing.
- Failure to pay may result in suspension or termination of services.
- All prices are subject to change. We will provide notice of any price changes in advance.
18. Data Protection and Privacy
- We process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR.
- You consent to the collection, use, and disclosure of your data as described in our Privacy Policy.
19. Limitation of Liability
- To the fullest extent permitted by law, ACSHOST shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use our services.
- Our total liability to you for any claim arising out of or relating to this Agreement shall not exceed the amount paid by you for the services in the 12 months preceding the claim.
- Nothing in this Agreement shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be limited by law.
20. Indemnification
- You agree to indemnify and hold harmless ACSHOST, its directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of this Agreement.
21. Changes to Terms
- We may update these Terms and Conditions from time to time. Continued use of our services constitutes acceptance of any changes.
- We will notify you of material changes via our website or email.
22. Governing Law
- This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
- Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
